TERMS OF SERVICE

By requesting, scheduling, or receiving services from Valley Flow Pool Care LLC (“Valley Flow,” “we,” “our,” or “us”), you agree to the following Terms of Service.
1. DEFINITIONS
For purposes of these Terms, “Aquatic Systems” includes swimming pools, spas, hot tubs, fountains, decorative water features, HOA water features, community water features, and other water-based systems serviced by Valley Flow Pool Care LLC.
2. SERVICES PROVIDED
Valley Flow Pool Care LLC provides maintenance, cleaning, water treatment, inspections, repairs, and related services for Aquatic Systems, including but not limited to:
• Water testing and chemical balancing
• Skimming and debris removal
• Brushing surfaces
• Emptying baskets and strainers
• Routine vacuuming as needed
• Visual equipment inspections
• Filter cleaning services
• Green-to-clean treatments
• Tile cleaning and calcium removal
• Fountain and water feature maintenance
• Equipment monitoring and recommendations
• Equipment repair and replacement services
• Other maintenance services offered by Valley Flow Pool Care LLC
Services provided may vary based on the service plan selected, system type, and existing conditions.
3. PROPERTY ACCESS
Customers authorize Valley Flow Pool Care LLC and its owners, employees, contractors, representatives, and agents to enter the property as reasonably necessary to perform scheduled services, inspections, maintenance, repairs, and related work.
Customers are responsible for ensuring:
• Gates are unlocked or access is provided
• Equipment is accessible
• Pets are secured
• Safe working conditions exist
If service cannot be performed due to lack of access, unsecured animals, unsafe conditions, or other circumstances beyond our control, the visit may be skipped and the customer may still be charged for the scheduled service.
4. CUSTOMER RESPONSIBILITIES
Customers are responsible for:
• Maintaining an appropriate water level between service visits
• Providing safe access to the Aquatic System and equipment
• Promptly addressing approved repairs and maintenance recommendations
• Maintaining accurate billing and contact information
• Ensuring utilities required for operation remain active
Valley Flow Pool Care LLC is not responsible for damage, equipment failure, water quality issues, or service interruptions resulting from low water levels, utility interruptions, inaccessible equipment, or unsafe conditions.
5. REQUIRED MAINTENANCE
Proper care requires periodic maintenance beyond routine service.
Valley Flow Pool Care LLC may recommend maintenance services including, but not limited to:
• Filter cleanings
• Basket and strainer replacement
• Equipment repairs
• Equipment replacement
• Plumbing repairs
• Leak repairs
• Valve repairs
• Pump repairs
• Other maintenance necessary for proper operation
Customers acknowledge that declining recommended maintenance may negatively impact appearance, water quality, sanitation, equipment performance, and service effectiveness.
Repeated refusal of required maintenance may result in suspension or termination of recurring service.
6. FILTER CLEANING REQUIREMENTS
Filter cleaning is a required component of proper maintenance.
For most residential systems, Valley Flow Pool Care LLC recommends quarterly filter cleaning. Certain filter types, environmental conditions, system configurations, commercial installations, or usage patterns may require more frequent maintenance.
Valley Flow Pool Care LLC reserves the right to require filter cleaning or other maintenance when necessary to maintain proper operation.
Customers who decline recommended filter cleaning acknowledge that Valley Flow Pool Care LLC is not responsible for resulting water quality issues, equipment damage, algae growth, reduced circulation, increased chemical usage, sanitation issues, or other related problems.
7. CUSTOMER-PERFORMED MAINTENANCE
To ensure proper operation and water quality, Valley Flow Pool Care LLC requires that recommended maintenance services be performed by Valley Flow Pool Care LLC or by a service provider approved by Valley Flow Pool Care LLC.
Customers who independently perform required maintenance or decline recommended maintenance may not be eligible for continued recurring service.
Valley Flow Pool Care LLC is not responsible for service issues resulting from customer-performed maintenance, improper repairs, delayed repairs, or unapproved service work.
8. CHEMICALS AND SPECIALTY TREATMENTS
Routine water testing and balancing are included in recurring service plans as specified by the customer’s selected service level.
Certain specialty treatments and chemicals may require additional charges, including but not limited to:
• Phosphate removers
• Algae remediation treatments
• Metal treatments
• Stain treatments
• Salt cell cleaning
• Green-to-clean treatments
• Specialty water chemistry corrections
• Other chemicals or treatments beyond normal weekly maintenance
Valley Flow Pool Care LLC reserves the right to recommend additional treatments when necessary to maintain proper water quality and system operation.
9. BILLING AND PAYMENT TERMS
Recurring service customers must maintain a valid payment method on file.
Customers may choose either automatic billing or standard invoicing.
Customers enrolled in automatic billing may qualify for discounted recurring service pricing. Customers who choose standard billing will continue to receive service but will not receive any applicable Auto-Pay discounts.
Invoices are due upon receipt.
A seven (7) day grace period will be provided for outstanding balances.
Accounts that remain unpaid for fourteen (14) days may be subject to service suspension until payment is received.
Valley Flow Pool Care LLC reserves the right to charge approved recurring service fees, authorized maintenance services, and outstanding balances to the payment method on file when authorized by the customer.
Customers are responsible for maintaining current billing information and ensuring payment methods remain valid and up to date.
10. SERVICE SCHEDULING
Valley Flow Pool Care LLC schedules service based on route efficiency, service area, weather conditions, holidays, equipment availability, staffing needs, and operational requirements.
Customers may request scheduling preferences; however, Valley Flow Pool Care LLC does not guarantee specific service times.
Service days may occasionally change due to weather, route adjustments, holidays, vacation periods, equipment issues, staffing needs, or other operational considerations.
11. HOLIDAYS, VACATIONS, AND SERVICE INTERRUPTIONS
Valley Flow Pool Care LLC may observe holidays, scheduled vacation periods, training days, or other business closures throughout the year.
Customers will be notified in advance whenever reasonably possible.
Monthly recurring service pricing is based on annual service availability and route scheduling rather than the exact number of visits performed during any specific month.
Temporary service interruptions due to holidays, vacation periods, weather events, or operational considerations do not entitle customers to prorated billing, credits, or refunds unless otherwise determined by Valley Flow Pool Care LLC.
12. STORMS, NEGLECT, AND EXTRAORDINARY CONDITIONS
Routine recurring service is intended to maintain a reasonably clean and properly operating Aquatic System.
Significant debris accumulation, severe algae growth, storm cleanup, vandalism, construction contamination, neglected systems, abandoned systems, or other extraordinary conditions may require additional services and charges beyond standard recurring service.
Valley Flow Pool Care LLC reserves the right to determine when conditions exceed the scope of routine maintenance.
13. EXISTING WATER QUALITY CONDITIONS
Valley Flow Pool Care LLC does not guarantee immediate water clarity, sanitation, or restoration of an Aquatic System when service begins on a system with pre-existing water quality issues, algae growth, equipment failures, deferred maintenance, contamination, or neglected conditions.
Additional treatments, repairs, cleanings, and time may be required to restore proper operation and water quality.
14. EQUIPMENT REPAIRS AND REPLACEMENTS
Valley Flow Pool Care LLC may provide repair, replacement, troubleshooting, installation, and maintenance services for pumps, motors, filters, heaters, automation systems, plumbing components, valves, lights, salt systems, fountains, water features, and other Aquatic System equipment.
Repair and replacement services are generally not included in recurring service plans unless specifically stated otherwise.
Customers will be provided with an estimate or quote when practical before repairs are performed. Certain emergency repairs or minor repairs necessary to protect equipment or prevent additional damage may be performed with customer authorization.
Valley Flow Pool Care LLC does not guarantee that repair services will correct all existing issues, particularly where equipment has multiple failures, significant age-related deterioration, manufacturer defects, improper prior installation, or undiscovered conditions.
Manufacturer warranties, when applicable, remain subject to the terms and conditions established by the manufacturer.
Customers are responsible for approving and paying for repairs, replacement parts, equipment upgrades, and labor charges not included in their recurring service plan.
Valley Flow Pool Care LLC is not responsible for equipment failures, water quality issues, property damage, or related losses resulting from declined repairs, delayed repairs, deferred maintenance, or refusal of recommended maintenance.
15. PHOTOGRAPHS AND DOCUMENTATION
Valley Flow Pool Care LLC may take photographs of Aquatic Systems, equipment, service areas, and related conditions for documentation, service records, estimates, quality control, maintenance recommendations, warranty support, training, and dispute resolution.
These photographs will be handled in accordance with the Valley Flow Pool Care LLC Privacy Policy.
16. HOA, COMMERCIAL, AND MULTI-PROPERTY ACCOUNTS
Additional service terms, billing arrangements, scheduling requirements, reporting requirements, insurance requirements, and maintenance standards may apply to HOA, commercial, municipal, or multi-property accounts.
Where applicable, separate service agreements may supplement these Terms of Service.
17. LIMITATION OF LIABILITY
Valley Flow Pool Care LLC carries commercial liability insurance; however, customers acknowledge that equipment and systems may fail due to age, wear and tear, manufacturer defects, improper installation, prior damage, environmental conditions, or other factors outside our control.
To the fullest extent permitted by law, Valley Flow Pool Care LLC and its owners, employees, contractors, representatives, and agents shall not be liable for damages resulting from:
• Pre-existing conditions
• Manufacturer defects
• Normal wear and tear
• Weather events
• Acts of nature
• Utility interruptions
• Low water levels
• Customer negligence
• Customer-performed maintenance
• Refusal of recommended maintenance
• Delayed repairs
• Equipment failures unrelated to services performed by Valley Flow Pool Care LLC
18. SERVICE SUSPENSION AND TERMINATION
Valley Flow Pool Care LLC reserves the right to suspend or terminate service at its discretion for reasons including, but not limited to:
• Repeated late payments
• Declined required maintenance
• Unsafe working conditions
• Aggressive animals
• Inaccessible equipment
• Harassment or abusive behavior toward Valley Flow personnel
• Customer-performed maintenance contrary to these Terms
• Any condition that prevents proper care or operation
19. CANCELLATION POLICY
Either party may terminate recurring service by providing seven (7) days written notice.
Outstanding balances remain due upon termination.
20. RIGHT TO REFUSE SERVICE
Valley Flow Pool Care LLC reserves the right to refuse service to any customer or property when conditions are unsafe, unreasonable, or incompatible with our service standards.
21. ACCEPTANCE OF TERMS
By requesting, scheduling, or receiving services from Valley Flow Pool Care LLC, the customer acknowledges that they have read, understood, and agreed to these Terms of Service.
